Terms of Service for Harbour Ace Tennis Academy

1. Introduction and Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the services, facilities, programs, content, and related offerings provided by Harbour Ace Tennis Academy ("we", "us", "our"). By booking, registering for, attending, purchasing, or otherwise using any service provided by Harbour Ace Tennis Academy, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree to these Terms, you must not use our services. Where a participant is under 18 years of age, a parent or legal guardian must accept these Terms on the participant’s behalf and is responsible for ensuring compliance with them.
2. Scope of Services
Harbour Ace Tennis Academy provides tennis-related services including, without limitation:
- Private tennis coaching;
- Group tennis lessons;
- Junior development programs;
- Adult beginner clinics;
- Match play and strategy sessions;
- Stringing and racket consultation; and
- School and corporate tennis programs.
Services may be delivered at our premises, at third-party venues, at schools, clubs, public courts, or other locations as arranged. We may modify, suspend, or discontinue any service, coach assignment, schedule, venue, or program at our discretion, subject to applicable law and any specific written agreement with you.
3. User Obligations and Responsibilities
By using our services, you agree that you will:
- Provide accurate, complete, and up-to-date registration and contact information;
- Ensure that you or the participant are physically fit and medically able to participate in tennis activities;
- Disclose any relevant medical conditions, injuries, allergies, or special needs that may affect participation;
- Follow all safety instructions, venue rules, coach directions, and reasonable operational requirements;
- Use appropriate sports attire and equipment suitable for tennis activities;
- Act respectfully toward coaches, staff, other participants, venue operators, and members of the public;
- Not engage in abusive, disruptive, unsafe, unlawful, or discriminatory conduct;
- Not attend sessions while under the influence of alcohol, drugs, or any substance that may impair judgment or performance;
- Supervise minors in your care where required and ensure timely drop-off and pick-up; and
- Comply with all applicable laws and regulations in Hong Kong.
You are responsible for the condition and suitability of any personal equipment you bring, including rackets, shoes, and protective items. We may refuse participation where we reasonably believe a participant’s conduct, health, or equipment creates a safety risk.
4. Payment Terms and Conditions
Fees for services will be communicated at the time of booking, registration, quotation, or invoice. Unless otherwise stated in writing, all fees are payable in advance and in Hong Kong dollars (HKD).
- Bookings are confirmed only upon receipt of full payment or such deposit as we may require;
- Any bank charges, payment processing fees, or currency conversion costs are your responsibility unless we agree otherwise;
- We may suspend or withhold services for overdue amounts;
- Prices may change from time to time, but changes will not affect services already paid for, except where required by law or expressly agreed;
- Corporate, school, or group bookings may be subject to separate written terms, purchase orders, or invoices.
If a payment is reversed, disputed, or charged back without valid reason, you remain liable for the outstanding amount and any reasonable administrative or recovery costs incurred by us, to the extent permitted by law.
5. Cancellation and Refund Policy
Cancellations and rescheduling requests must be made in accordance with our booking rules or any written confirmation provided for the relevant service. Unless otherwise stated, the following policy applies:
- Private lessons: cancellations made with less than 24 hours’ notice may be charged in full;
- Group lessons and programs: missed sessions are generally non-refundable and non-transferable;
- Junior, adult, school, and corporate programs may have separate attendance, make-up, or cancellation rules;
- Refunds, if any, are at our discretion except where required by law or expressly stated in writing;
- We may cancel or reschedule sessions due to weather, venue closure, coach illness, safety concerns, or other operational reasons.
Where we cancel a paid session and cannot reasonably provide a replacement session or alternative arrangement, we may offer a make-up session, credit, or refund at our discretion, subject to applicable law and the circumstances of cancellation. No refund will be provided for partial attendance, late arrival, or non-attendance by the participant, except where required by law or expressly agreed in writing.
6. Liability Limitations
Tennis is a physical sport involving inherent risks, including but not limited to slips, falls, collisions, overexertion, heat-related illness, equipment failure, and injuries caused by balls, rackets, court surfaces, or other participants. By participating, you acknowledge and accept these risks to the fullest extent permitted by law.
To the maximum extent permitted by the laws of Hong Kong:
- We do not exclude or limit liability for death or personal injury caused by our negligence, fraud, or any liability that cannot lawfully be excluded;
- We are not liable for indirect, incidental, special, consequential, or punitive losses, including loss of profits, loss of opportunity, or loss of data;
- Our total aggregate liability arising out of or in connection with any service shall be limited to the amount paid by you for the relevant service giving rise to the claim, except where prohibited by law;
- We are not responsible for loss, theft, or damage to personal property brought to any venue, except to the extent caused by our proven negligence and as required by law;
- We are not responsible for injuries, losses, or damages arising from your failure to follow instructions, disclose relevant medical information, or use suitable equipment.
Nothing in these Terms excludes any rights or remedies that cannot be excluded under applicable Hong Kong law, including the Control of Exemption Clauses Ordinance (Cap. 71) and the Supply of Services (Implied Terms) Ordinance (Cap. 457), where applicable.
7. Intellectual Property Rights
All materials provided by Harbour Ace Tennis Academy, including lesson plans, drills, training methods, written materials, videos, images, logos, branding, website content, and other proprietary content, are owned by or licensed to us and are protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, modify, publish, transmit, sell, or otherwise exploit our materials without our prior written consent, except for personal, non-commercial use expressly permitted by us. Any feedback, suggestions, or ideas you provide may be used by us without restriction or compensation, to the extent permitted by law.
8. Data Protection and Privacy
We collect, use, store, and process personal data in connection with bookings, payments, communications, safety, administration, coaching, and service improvement. We will handle personal data in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong and our applicable privacy practices.
By using our services, you consent to our collection and use of personal data for legitimate business purposes, including:
- Managing registrations, attendance, and payments;
- Communicating schedule changes, reminders, and service updates;
- Maintaining safety records and emergency contact information;
- Assessing suitability for coaching or program placement;
- Complying with legal, regulatory, tax, and accounting obligations.
We may share personal data with service providers, venue operators, payment processors, or other third parties only where necessary for service delivery, legal compliance, or with your consent where required. You may contact us to request access to or correction of your personal data, subject to applicable legal rights and obligations.
9. Force Majeure
We shall not be liable for any delay, failure, or inability to perform our obligations where such delay or failure is caused by events beyond our reasonable control, including but not limited to extreme weather, typhoons, black rainstorm warnings, government restrictions, public health emergencies, venue unavailability, strikes, transport disruptions, power failures, acts of God, civil unrest, or other force majeure events.
In such circumstances, we may suspend, postpone, reschedule, or cancel affected services and may offer alternative arrangements where reasonably practicable.
10. Changes to Terms
We may update or revise these Terms from time to time to reflect changes in our services, operational requirements, or applicable law. The revised Terms will take effect from the date stated in the updated version or, if no date is stated, upon publication or communication to you.
Your continued use of our services after any change constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using our services.
11. Applicable Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Subject to any mandatory legal provisions, you agree that the courts of Hong Kong shall have exclusive jurisdiction to resolve any dispute arising out of or in connection with these Terms, our services, or any related non-contractual obligations.

13. Severability Clause
If any provision of these Terms is held to be invalid, unlawful, void, or unenforceable by a court or competent authority, that provision shall be deemed severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect. If any invalid or unenforceable provision can be modified to make it valid and enforceable, it shall be interpreted and applied to the extent necessary to achieve its intended purpose, consistent with applicable law.
These Terms constitute the entire agreement between you and Harbour Ace Tennis Academy regarding the subject matter herein and supersede any prior oral or written understandings to the extent permitted by law.
